Providing personal data, as well as consent to their processing are completely voluntary. II. PERSONAL DATA PROTECTION SYSTEM

PDA has applied technical and organizational measures ensuring the protection of processed data, in accordance with the requirements specified in applicable legislation on personal data protection. In particular, the reviewed legislation includes: the Regulation of the Minister of Interior and Administration of 29 April 2004 on documenting data processing and technical and organizational conditions that shall be met by devices and IT systems used for the processing of personal data (O.J. no 100, item 1024); guidelines of the Inspector General for Personal Data Protection; Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processinng ofpersonal data and on the free movement of such data, and repealing Directive 95/46/EC. 

The most important elements of the personal data protection system include:

  • SSL certificate which guarantees that communication between your computer and byrieske.com uses 256-bit key encryption.
  • We collect and process only the necessary personal data and for the shortest possible period and you need to give consent to any actions unrelated to the performance of the sales agreement.
  • Access to your personal data is only granted to persons who are authorised and trained in the area of personal data protection, who guarantee security.
  • Byrieske.com IT system and internal company procedures comply with all personal data protection standards. PDA has thus complied with all the legal requirements in the area of personal data protection.

III. PERSONAL DATA PURPOSE AND PERIOD OF STORAGE

A. REGISTRATION

During registration, please provide us with the data necessary to set up an account at byrieske.com, so you do not have to waste time refilling the entire order form with each subsequent purchase. By registering, you save time and money because registered customers get discounts for earlier purchases.

Registered customer after logging in also has the ability to verify the status of the order and the history of purchases made. A registered and logged in customer can correct, complete or delete data from byrieske.com at any time.

During registration, we are asking:

  • name and surname - necessary for us to later issue a sales document and address the package;
  • address (street, house number/ or house and apartment number, zip code and city) - we need later to address the package;
  • e-mail - necessary for logging in and communication related to using byrieske.com;
  • telephone number - necessary in case of choosing some delivery methods (required by carriers). Data is stored for 5 years from the last login.

B. PLACING THE ORDER

When placing an order we ask you to provide the data necessary to complete the order, which in the case of registered and logged in Clients are partially collected automatically from the data provided during registration.

When placing an order we ask you to provide:

  • name and surname or name of the company/ institution - necessary to issue a sales document and address the parcel;
  • address (street, house number/ or house and apartment number, zip code and city) - necessary to address the parcel;
  • e-mail - necessary for communication related to the implementation of the order;
  • telephone number - necessary in case of choosing some delivery methods (required by carriers).

In the case that when placing an order, the customer chooses a delivery to a different address than the one indicated at the registration or ordering, please also provide:

  • name and surname or name of the company/ institution - we need to address the parcel;
  • address (street, house number/ or house and apartment number, zip code and city) - necessary to address the parcel;
  • phone number to the consignee's recipient - indispensable when choosing certain delivery methods (required by carriers).

If, when placing an order, the Customer chooses to issue a sales document for other data than indicated at registration or placing an order, please also provide:

  • name and surname or name of the company/ institution - necessary to issue a proof of sale;
  • address (street, house number/ or house and flat number, zip code and city) - necessary to issue proof of sale;

Data provided during the placement of an order shall be processed by rieske.com and the following entities to the extent specified below:

1. name, surname, address, telephone number, e-mail specified as the shipping address are provided in the form of a label / consignment note which is also a delivery order depending on the selected type of shipment to the shipping company:

a. DPD Polska Sp. z o.o. with its registered office in Warsaw 02-274, ul. Mineralna 15 (KRS: 0000028368, NIP: 525-020-41-10)

2. name and surname, address, NIP indicated as data for which a sales document is to be issued are transferred in the form of a sales document to the accounting system:

a. Power Blue Media SA with its registered office in Wrocław (KRS: 0000281947, NIP: 898-16-47-572) website operator ifirma.pl

If the selected method of payment uses and external payment system, any data provided after entering the website of the payment operator shall be registered only in their data base and shall in no way be available or stored byrieske.com.

Byrieske.com cooperates with the following payment operators:

  • Pay Pro SA with its registered office in Poznan 60-327, ul. Kanclerska 15 (KRS: 0000347935, NIP: 779-236-98-87)
  • PayPal (Europe) S.à r.l. et Cie, S.C.A.,Société en Commandite par Actions with its registered office in 22-24 Boulevard Royal, L-2449 Luxembourg, R.C.S. Luxembourg B 118 349

Data shall be stored for a period of 5 years after the end of the calendar year which follows the year in which the receipt was issued, pursuant to applicable legislation regulating the period of storing accounting documents.

C. MARKETING

If you subscribe to the newsletter and agree to receive it in the registration or ordering process, please only enter the e-mail address to which I will send commercial information from byrieske.com, which you can unsubscribe at any time by logging in to your account at byrieske .com or by clicking the link canceling the subscription and located in the footer of each newsletter.

D. CORRESPONDENCE

In the event of obtaining data which is not necessary to perform the agreement or our legal obligations, e.g. in correspondence, termination forms, warranty or guarantee, such data shall be deleted or anonymized without delay and shall not be processed.

We would therefore like to ask you not to disclose information and personal data which we do not explicitly ask for and which is not meaningful for the performance of the agreement or our legal obligations.

IV. COOKIES - YOUR PERSONAL DATA AUTOMATICALLY COLLECTED UPON ENTERING BYRIESKE.COM

Cookies are IT data, in particular text files, which are stored in the byrieske.com Customer’s terminal equipment. 

Byrieske.com uses two principal types of cookies: session cookies and persistent cookies. Session cookies are temporary files which are stored in the Customer's terminal equipment until log out, leave the website or switch off the software (internet browser). Persistent cookies are stored in the Customer’s terminal equipment for a period specified in the cookies parameters or until removed by the Customer.

Byrieske.com uses the following types of cookies:

  • “necessary" cookies, which enable the use of services available at byrieske.com, e.g. authentication cookies used for services which require authentication;
  • cookies used to ensure security, e.g. used to detect cases of authentication abuse at byrieske.com;
  • “performance” cookies, enabling us to collect information about the use of byrieske.com website;
  • "functional" cookies, enabling “memorizing” settings selected by the Customer and personalizing byrieske.com interface;
  • “advertising’ cookies, enabling the delivery of advertising content more relevant to the customer’s interests.

A. BYRIESKE.COM (SERWER)

The IT system used by byrieske.com automatically collects in logs files the data related to the device you use when you enter byrieske.com. Such data shall only be collected for statistical purposes and relate to: type of device, operating system, type of internet browser, screen resolution, colour depth, IP, internet service provider or the address of access to byrieske.com and shall only be used to optimise byrieske.com and ensure its optimal user-friendliness. Such data shall never be linked to disclosed data referred to in section III and shall only constitute material for statistical analysis and system error correction mechanisms.
Byrieske.com uses servers by OVH sp. z o.o., with registered office in Wrocław (National Court Register No: 0000220286, tax ID no: 8992520556) and store software by NetArch Sp. z o.o., with registered office in Krakow (National Court Register No 0000286559; tax ID no: 945-208-91-38. These companies have no direct access to personal data and will in no way process such data.

The data shall be stored for 24 months following the last activity.

B. BYRIESKE.COM (COOKIES)

Byrieske.com uses the technology of cookies, i.e. text files stored on your device, in order to enable byrieske.com to recognize you and adjust byrieske.com to your needs.

Byrieske.com uses cookies to:

  • remember the sign in (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  • remember the content of your basket (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  • remember your byrieske.com screening preferences (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  • making statistics and viewing reports of byrieske.com website operation (the session lasts 30 minutes from the last activity, after which the cookie is deleted);

Google Analytics uses the technology of cookies, i.e. text files stored on your device to enable byrieske.com to analyse sources of traffic and the way visitors use the website.

Google collects on its servers data obtained from placing cookies on devices and uses this information in order to create reports and provide other services related to traffic and internet use.

Google may also communicate this information to third parties if it is so legally obliged or if such parties process such information on behalf of Google.

Google collects on its servers data collected from placing cookies on devices and uses this information in order to create reports and provide other services related to traffic and internet use.

Google may also communicate this information to third parties if it is so legally obliged or if such parties process such information on behalf of Google.

Such data shall never be linked to disclosed data referred to in section III and shall only constitute material for statistical analysis and system error correction mechanisms.

The data shall be processed for 12 months following the last activity, after that the cookies are deleted.

E. COOKIES FROM PARTNER SERVERS

Byrieske.com uses scripts or elements of software delivered by and stored on the servers of its business partners. Such cookies may contain data necessary for the partner to perform the service provided to byrieske.com or data different from data listed in privacy policy.

Byrieske.com very carefully chooses its business partners, but it is not liable for their cookies policy. This is why we recommend that you verify each of our partners individually and decide independently whether you want to allow their cookies.

Byrieske.com uses the scripts of the following partners:

V. PRIVACY POLICY OF BYRIESKE.COM PARTNERS

Byrieske.com carefully chooses its business partners and equally carefully checks the links to other websites placed at byrieske.com. byrieske.com is not, however, liable for the standard and privacy protection policy applied by owners, operators or administrators of these websites. This is why we recommend that you verify each of our partners individually and decide independently decide whether you want to entrust your personal data to them.

VI.DISCLOSING OF YOUR PERSONAL DATA

In exceptional situations, when the Personal Data Administrator is legally obliged to disclose collected data to state authorities, byrieske.com shall disclose such data.

Except such situations, your personal data, to the extent permitted by the law and based on separate data disclosure agreements, shall be disclosed to specified entities solely for the purposes of performing the contractual or legal obligation of the Personal Data Administrator. Categories of entities to which data may be disclosed include: advertising agencies, banks, accounting offices, IT service providers, courier companies, logistics companies, payment institutions, carriers.

In the event of such disclosure, Personal Data Administrator shall conclude applicable data disclosure agreements with these entities, guaranteeing the highest standard of protection, ensuring the confidentiality and security of personal data, as well as use solely for the purpose of performing the contractual or legal obligation of the Personal Data Administrator.

VII. AMENDMENT OF BYRIESKE.COM PRIVACY POLICY

Byrieske.com reserves the right to amend its privacy policy, if this is required by law, or the technological conditions of byrieske.com operation change or if such an amendment introduces a standard higher than the minimal standard required by law. VIII.YOUR RIGHTS

Under applicable legislation regulating your personal data, you have the right to:

  • refuse or limit the consent to personal data processing;
  • submit an objection against personal data processing;
  • access to personal data;
  • correct or delete personal data;
  • transfer personal data;
  • withdraw your consent to the processing of personal data;
  • file a complaint to the supervision authority – the President of the Office for Personal Data Protection.

These rights are inalienable and may not be limited. We are always willing to provide help and information, and you may exercise some of the rights listed above independently.
